The Legal Aspects of the Improvement of the National System of Environmental Safety Identification

Environmental safety is the absence of the environmental threats. Environmental threats can be of anthropogenic and natural origin. They include all factors that can negatively influence the environment and create a hazard to human health, activities and property. Thus, the model of environmental hazard consists of 3 elements: a) the object (the environment); a direct hazardous source (of anthropogenic or natural origin); c) a negative influence of the direct hazardous source (environmental contamination, destruction or damage). The environmental management in the sphere of environmental safety insurance is effective only where a proper management system is created on the every element of the environmental hazard action. It must include: a) the environmental protection system (the system of liquidation of the results of the negative environmental influence and environmental improvement system); the negative environmental influence management system; c) direct environmentally hazardous sources management system.

It is necessary to note that unfortunately national Ukrainian legal system has no unified legislative basis in the sphere of environmental safety management. There are many legislative acts in Ukraine, that define the procedure of environmental management in some areas of the environmental safety: waste management, industrial plants management, nuclear energy management etc. But these procedures can’t be effective enough without creation of unified management basis for all direct environmentally hazardous sources.

To create the unified system of environmental safety management it is necessary to provide an effective system of environmental safety data identification. Such system is to be legally adopted. It can be created in a form of computer system of environmental safety identification (ESI). ESI system is to be created for the all regions and districts of Ukraine and must include: a) the identification of all direct environmentally hazardous sources of this district (external as well, as internal); the identification of hazard level for each environmental threat; c) the identification of hazard level for the whole district; d) the identification of the environmental safety factors (factors, that can increase or decrease the environmental hazard level: wind, level of radiation etc.); e) the identification of the fragile components of the environment; f) the identification of the environmental emergencies; g) the identifications of taken measures and their effectiveness.

ESI system can be used for the analysis of the environmental hazard level and for taking corrective and preventive actions to insure the environmental safety. All environmentally hazardous activities are to be assessed in the ESI system and on the result of such assessment a proper permission can be given and the environmental hazardous activities can be registered in the ESI system.
